Is an EICR a Legal Requirement?
For the majority of landlords, no change in behaviour will be required following the introduction of the Regulations that make it a legal requirement to have an EICR within their Rental property. However, for the minority of landlords who have not been keeping up to date with checks, the rules introduced in 2020 placed a strict burden on them to ensure properties are electrically safe.
Fines of up to £30,000
The landlord may be required to supply a copy of the EICR to the local authority within seven days. Local Authorities have the power to impose a financial penalty of up to £30,000 for a breach of duty.

Tenants & The EICR
Landlords must supply a copy of the report to existing tenants within 28 days of the inspection being carried out. When new tenants are to move into a property, they should be given a copy of the report before occupying the property.
Unsatisfactory Outcomes
If an unsatisfactory outcome is recorded, the report will identify urgent remedial work that is required. This further investigation or remedial work must be completed by a qualified and competent person within 28 days.
